LIABILITY RELEASE & SERVICE AGREEMENT

1. PAYMENT, BOOKING & FINANCIAL TERMS

1.1 A mandatory deposit is required to confirm booking, which is non-refundable under any circumstances, except where required by applicable law.

1.2 Full payment must be completed prior to departure, and no later than 72 hours before the start of the Experience.

1.3 Failure to complete payment within the required timeframe may result in automatic cancellation without guarantee of reinstatement.

2. CANCELLATION, REFUND & PENALTY POLICY

2.1 Cancellations made 72 hours or more prior to departure may be eligible for a partial refund, subject to a 30% administrative penalty based on the total tour price, plus the non-refundable deposit.

2.2 Cancellations made less than 72 hours before departure, as well as no-shows, are not eligible for any refund or compensation.

2.3 If the Operator cancels due to force majeure (weather, safety, logistics, or insufficient participants), the Client will receive either rescheduling or a full refund including the deposit.

3. LIABILITY WAIVER & RELEASE

3.1 The Client acknowledges that the Experience involves outdoor activities with inherent risks including transportation, uneven terrain, animal interaction, and farm environments.

3.2 The Client voluntarily assumes all risks associated with participation.

3.3 The Client releases Canadian Route Learning Centre Incorporation, its staff, affiliates, and partners from any liability for injury, loss, damage, or incidents during the Experience.

3.4 Canadian Route is not responsible for lost, stolen, or damaged personal belongings.

3.5 The Client confirms they are physically and mentally fit to participate and agrees to follow all safety instructions.

3.6 Transportation and Tour Incident Liability

The Client acknowledges that transportation for this Experience is provided by a licensed third-party carrier. The Client understands that all transportation services are subject to the carrier’s own insurance, safety procedures, and operating terms. Canadian Route shall not be held liable for any injury, accident, illness, loss, damage, or claim arising from the operation of the transportation vehicle or from any incident occurring during the Experience.

4. PAYMENT ACCEPTANCE & CHARGEBACK PROTECTION

4.1 The Client acknowledges that payment is for a date-specific tourism service subject to agreed terms.

4.2 This agreement serves as proof of acceptance of all service conditions.

4.3 In the event of a chargeback, Canadian Route may submit this agreement, payment records, and communications as evidence of authorization.

4.4 The Client acknowledges that unjustified disputes may affect future service eligibility, where permitted by law.

5. IMAGE RELEASE & MARKETING USE

5.1 The Client authorizes Canadian Route Inc to capture photos and videos during the Experience in which they may appear.

5.2 The Client grants a free, worldwide, perpetual license for promotional and marketing use of such material.

5.3 The Client acknowledges no compensation will be provided for use of their image.

5.4 The Client may request in writing prior to the Experience not to be included in promotional content.

6. ACCEPTANCE

By making any payment, the Client confirms full understanding and acceptance of all terms in this Agreement.
